IRS CONTINUES TO TURN "BLIND EYE" TO HSUS SPENDING OVER $500 MILLION ON LOBBYING!

March 26, 2014 may prove to be the  RED LETTER "WATERLOO" DAY for the HSUS!   On that Day the HSUS submitted a Declaration that was prepared by Jennifer Fearing, the HSUS California Senior State Director and the HSUS Deputy Director of Programs and Policy.   This Declaration was submitted by the HSUS in the Lawsuit that was filed in the U.S. District Court for the Eastern District of California in support of its "Legal Standing" to intervene as a "Defendant" in the Lawsuit that challenges the California "Egg" Statute that was passed several years ago.  This Lawsuit was filed by Six State Attorneys General.  With unbridled arrogance, the HSUS has attempted to defend the "Egg" Statute with the Declaration that was prepared by Ms. Fearing.  However, in so doing, it may end up having  "egg on its face" because it has unwittingly opened a huge door that will make it increasingly difficult for Members of Congress and the Treasury Department to ignore a "5,000 pound Gorilla" that is lurking and "walking the Halls of Congress!"  In short, this Declaration constitutes a "Judicial Admission" that the HSUS may have expended over $500 Million on its lobbying campaigns that resulted in Mr. Pacelle boasting:  "We have passed 1,000 Laws in  the last decade."

If the tens of thousands of caring individuals who have been targeted by the HSUS for "extinction," and who have figuratively felt the smelly breath of the HSUS breathing down their necks, will take but a few minutes to go to the “Find your Congress People” link on Franklosey.com, and copy and paste the following text to E-Mails that are sent to their Two U.S. Senators and One U.S. Representative, it could turn the tide against the HSUS, and set the stage for the IRS to revoke the tax-exempt, public charity status of the HSUS.

Dear Senator/Representative __________

Would you please contact the Secretary of the Treasury and ask him to expedite an investigation  (Complaint File Number: 55-1307-0105-C) of why the IRS has ignored for more than five years more than 3,000 pages of incriminating documents that conclusively substantiate that the tax-exempt, public charity status of the Humane Society of the U.S. (HSUS) should be revoked because the HSUS has expended more than $500 Million on lobbying over a period of 10 years, which is why Mr. Pacelle, the President and CEO of the HSUS, has boasted: "We have passed 1,000 laws in the last decade." 

My request to you is based on the following facts:

First, Mr. Pacelle has boasted that "We have passed 1,000 laws in the last decade."  No Multi-Billion Dollar for Profit Corporation has ever been responsible for the passage of 1,000 Laws.  (To hear this confessional admission by Mr. Pacelle go to www.franklosey.com and click on the pacelle confessions link.

Second, Mr. Wayne Pacelle and the HSUS were previously registered respectively as a "Lobbyist" and as a "Lobbying Organization" with both Houses in Congress before they began "covering up" the magnitude of their lobbying activities on the HSUS Tax Returns in order to avoid losing its tax-exempt, public charity status.

Third, on March 26, 2014, the HSUS submitted to the U.S. District Court for the Eastern District of California a "Declaration" prepared by Ms. Jennifer Fearing, the HSUS California Senior State Director and the HSUS Deputy Director of Programs and Policy.   This "Declaration" was submitted by the HSUS to support its "Legal Standing" to intervene as a "Defendant" in the Lawsuit that challenges the California "Egg" Statute that was passed several years ago.  Of note, this Lawsuit was filed by Six State Attorneys General.   What is so riveting in the "Declaration" is Ms. Fearing's descriptions of the commitment of the HSUS resources to pass the Proposition 2 Ballot Initiative in California as a prelude to lobbying for enactment of the Law being challenged by the State Attorneys General.  Key quotes from Ms. Fearing's Declaration include:

         "The HSUS committed substantial financial and human resources to coordinating and gathering more than 700,000 registered voters' signatures throughout California."

         The HSUS and the Yes on Prop 2 campaign, which I directed, reported financial contributions in support of Proposition 2's passage that exceeded $10,000,000.  That amount includes the cost of activities described above, as well as advertising costs and other expenses."

         "I and other staff and members of The HSUS spent hundreds of hours in furtherance of AB 1437's passage, and made AB 1437 our top legislative priority during the two years it took to move through the legislature and secure Governor Schwarzenegger's signature."

While I recognize that the HSUS did not expend $10 Million and thousands of unreported hours of HSUS staff time and the time of the unpaid HSUS volunteers for each of the 1,000 laws that the HSUS lobbied for enactment, it is not unreasonable to assume that the HSUS, on average, would spend at least 5% of that amount of money and time to secure passage of each of the 1,000 laws.  And if one multiplies the "5% average" times 1,000 laws, that would extrapolate to mean that in a decade the HSUS expended over $500 Million - - Half of a Billion Dollars! - - and Tens of Thousands, and quite possibly Hundreds of Thousands, of unreported Hours of the HSUS Staff and its Volunteers to the Lobbying Efforts of the HSUS over a period of 10 years!

Fourth, Thirty-One Members of Congress have previously contacted either the IRS, the Treasury Department, the Justice Department or all three of these Federal Agencies for the express purpose of expressing their concerns and those of their constituents about the failure of the IRS to hold the HSUS accountable for its excessive lobbying activities.

Fifth, Ms. Lois Lerner, the Disgraced IRS Official, is a Member of the HSUS!

It is imperative that Congress act swiftly to ensure that the Department of the Treasury and the IRS apply the provisions of the U.S. Tax Code, as enacted by Congress, in a fair and objective manner.  For the IRS to ignore the expenditure of $500 Million by a charity is not only unconscionable, but it mocks the authority of the U. S. Congress.
